sponsor licence management

The importance of maintaining and updating your Sponsor Licence is paramount.

At Kalsi Solicitors our expert team are well versed in assisting in the implementation of updates, maintaining your Sponsor Licence and ensuring to avoid the potential consequences of failing to do so.

We have a simple approach to what is an ever-changing set of rules and requirements. The main reasons for failure to properly maintain and update a Sponsor Management System are:

  • Lack of the required knowledge and skill sets within the business.
  • Lack of a specified Individual to take responsibility for this important responsibility.
  • Failure to ensure that key areas such as Visa expiry dates, changes of status, changed terms of employment or work location for Migrant staff or proposed changes to your business structure are identified, checked and updated when necessary and within the required timescale.

Sponsor Duties

As a sponsor you have several responsibilities and will be required to maintain a number of duties to ensure you remain compliant with your responsibilities. The following are a few examples:

  • You must check that your foreign workers have the necessary skills or qualifications to be able to do their jobs. You should keep copies that show this.
  • You must tell UKVI if your sponsored workers are not complying with their visa conditions.
  • You must only assign Certificates of Sponsorship to workers when the job is suitable for sponsorship.
  • You should have HR systems in place that let you:
    • Monitor your employees’ immigration status.
    • Track and record employee attendance.
    • Keep employee contact details up to date.

If you do not perform your responsibilities, your licence may be downgraded, suspended or withdrawn.

At Kalsi Solicitors, our expert staff can offer support assistance and training to your HR team and staff regarding their Sponsor Licence needs. Alternatively, for those seeking a more robust offering, we can provide a Maintenance package tailored to your requirements. We can be appointed as Representatives on your Sponsor Licence and can have one of lawyers added as a Level 1 or level 2 User to allow us to assist you in both advising you on what to do and when or even to update licences for you. This also allows you access to telephone and email support with any questions you may have with regards to your Sponsor Licence or Migrant Staff.
